Jurisdiction: Republic of Haiti
Fast n’ Easy Logistics provides International Freight Forwarding (primarily imports into Haiti) and Local Trucking & Domestic Transportation Services within Haiti. By using our services, you agree to the following Terms and Conditions.
1. COMPANY LEGAL STATUS
Fast n’ Easy Logistics operates under the Haitian Commercial Code, Haitian Civil Code, Haitian Customs Regulations, and applicable international transport conventions.
The Company acts:
- As Freight Forwarder (Agent) for international shipments.
- As Transport Operator (Carrier) for local trucking services within Haiti.
2. INTERNATIONAL FREIGHT FORWARDING (IMPORT SERVICES)
For international shipments, the Company acts solely as agent arranging transport.
Maritime shipments may be governed by applicable international conventions and U.S. maritime law when relevant. Air shipments may be governed by applicable international air carriage conventions.
Liability for loss or damage during international carriage rests with the performing carrier. Fast n’ Easy Logistics is liable only for proven negligence in arranging services.
3. LOCAL TRUCKING & DOMESTIC TRANSPORT (HAITI)
For local transportation including goods deliveries, container transport, warehouse transfers, residential or commercial moving services, and equipment relocation, the Company acts as carrier under Haitian civil and commercial law.
The Company shall be liable for direct loss or damage occurring while goods are under its custody, subject to proof of negligence and proper packaging by the Client.
Liability shall not exceed the declared value of the goods. If no value is declared, compensation shall be limited to reasonable market value.
The Company is not liable for pre-existing damage, poor packaging, mechanical breakdown not due to negligence, force majeure, armed robbery or uncontrollable criminal events, or indirect/consequential losses.
4. MOVING SERVICES (RELOCATION)
Clients must declare high-value and fragile items in advance. Special packing services must be requested separately.
The Company is not liable for undeclared valuables such as jewelry, cash, confidential documents, or similar items unless accepted in writing.
5. CLIENT RESPONSIBILITIES
Clients must provide accurate documentation, declare true value of goods, ensure proper packaging, pay all charges and taxes, and comply with Haitian import regulations.
False declarations may result in penalties under Haitian law.
6. PAYMENT & RIGHT OF RETENTION
All freight, trucking, storage, and related charges must be paid in full.
Under Haitian commercial law, the Company retains a right of retention (droit de rétention) over goods until full payment is received.
7. INSURANCE
Cargo insurance is not included by default.
Clients are strongly advised to obtain marine cargo insurance for imports and inland transport insurance for domestic deliveries. The Company may assist in arranging insurance as intermediary only.
8. FORCE MAJEURE
The Company is not liable for delays or loss caused by political instability, civil unrest, armed robbery, natural disasters, government restrictions, port congestion, or strikes.
9. CLAIMS PROCEDURE
Claims must be submitted in writing:
- Within 48 hours for domestic deliveries
- Within 7 days for visible international cargo damage
- Within 14 days for concealed damage
Claims must include proof of delivery, photos of damage, commercial invoice, and transport documentation.
Failure to comply may invalidate the claim.
10. DISPUTE RESOLUTION
Parties shall first attempt amicable resolution. If unresolved, disputes shall be submitted to the competent courts of the Republic of Haiti.
11. MODIFICATIONS
Fast n’ Easy Logistics reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
